Selon les derni\u00e8res statistiques d\u2019ONU Femmes, la R\u00e9publique D\u00e9mocratique du Congo affiche l'un des taux les plus \u00e9lev\u00e9s de violences sexuelles bas\u00e9es sur le genre (SGBV) au monde, avec plus de 50 % des femmes en RDC qui ont subi des violences physiques \u00e0 un moment donn\u00e9 de leur vie.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\n<p>Les femmes en situation de d\u00e9tention sont particuli\u00e8rement vuln\u00e9rables aux violences physiques, sexuelles et psychologiques. L'isolement, la surpopulation carc\u00e9rale et le manque de ressources adapt\u00e9es rendent leur situation encore plus pr\u00e9caire.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\n<p>Et pourtant, elles sont souvent invisibles dans les d\u00e9bats nationaux et internationaux sur les violences bas\u00e9es sur le genre. C\u2019est afin de rem\u00e9dier \u00e0 cette situation que Ius Stella a organis\u00e9 une campagne de sensibilisation et de consultations juridiques gratuites aupr\u00e8s de cette franche oubli\u00e9e de la population \u00e0 l\u2019occasion de la campagne des 16 jours d\u2019activisme contre les violences bas\u00e9es sur le genre.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b69d648 elementor-widget elementor-widget-image\" data-id=\"b69d648\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/ius-stella.org\/wp-content\/uploads\/2025\/04\/IMG_0506-768x512.jpg\" class=\"attachment-medium_large size-medium_large wp-image-1069\" alt=\"\" srcset=\"https:\/\/ius-stella.org\/wp-content\/uploads\/2025\/04\/IMG_0506-768x512.jpg 768w, https:\/\/ius-stella.org\/wp-content\/uploads\/2025\/04\/IMG_0506-300x200.jpg 300w, https:\/\/ius-stella.org\/wp-content\/uploads\/2025\/04\/IMG_0506-1024x683.jpg 1024w, https:\/\/ius-stella.org\/wp-content\/uploads\/2025\/04\/IMG_0506-1536x1024.jpg 1536w, https:\/\/ius-stella.org\/wp-content\/uploads\/2025\/04\/IMG_0506-2048x1365.jpg 2048w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-081f0c6 elementor-widget elementor-widget-heading\" data-id=\"081f0c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Victimes d\u2019un syst\u00e8me d\u00e9faillant<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ce4cfd elementor-widget elementor-widget-text-editor\" data-id=\"4ce4cfd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Au lancement de la campagne, 328 femmes \u00e9taient d\u00e9tenues \u00e0 la prison centrale de Makala ainsi que 20 enfants de moins de 5 ans vivaient en prison avec leurs m\u00e8res.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\n<p>Nos \u00e9quipes d\u2019avocats et \u00e9tudiants b\u00e9n\u00e9voles ont organis\u00e9 cinq sessions de sensibilisation qui ont permis d\u2019informer 207 femmes sur leurs droits fondamentaux. Des consultations juridiques gratuites ont \u00e9galement \u00e9t\u00e9 organis\u00e9es pour 75 femmes dont les dossiers avaient \u00e9t\u00e9 jug\u00e9s prioritaires.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\n<p>Ces actions ont mis en \u00e9vidence une r\u00e9alit\u00e9 alarmante : seulement 22,7% de ces femmes avaient eu acc\u00e8s \u00e0 un avocat avant leur incarc\u00e9ration. Pr\u00e8s de 8 femmes sur 10 (78,7%) \u00e9taient en d\u00e9tention pr\u00e9ventive, et n\u2019avaient jamais \u00e9t\u00e9 jug\u00e9es. Par ailleurs, l'\u00e2ge moyen des femmes rencontr\u00e9es \u00e9tait de 34 ans, avec des profils vari\u00e9s allant de 17 \u00e0 69 ans.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\n<p>Ces donn\u00e9es r\u00e9v\u00e8lent les failles profondes du syst\u00e8me judiciaire congolais qui ont un impact beaucoup plus large sur la soci\u00e9t\u00e9. Les femmes sont les piliers de la soci\u00e9t\u00e9 et les moteurs du d\u00e9veloppement car leur influence s'\u00e9tend bien au-del\u00e0 du cadre familial, impr\u00e9gnant chaque aspect de la vie sociale et \u00e9conomique. Leur incarc\u00e9ration est donc une probl\u00e9matique qui touche au c\u0153ur m\u00eame du tissu de notre soci\u00e9t\u00e9 et affecte profond\u00e9ment notre avenir collectif.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05bce65 elementor-widget elementor-widget-heading\" data-id=\"05bce65\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Une mobilisation exceptionnelle des \u00e9tudiants et des avocats<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d73ad15 elementor-widget elementor-widget-text-editor\" data-id=\"d73ad15\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>One of the campaign\u2019s cornerstones was the active involvement of students from the Human Rights Club of the University of Kinshasa, as well as two partner law firms: Shematsi &amp; Associates and KMG.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:paragraph --><\/p>\n<p>Les seize \u00e9tudiants en droit, soigneusement s\u00e9lectionn\u00e9s, ont b\u00e9n\u00e9fici\u00e9 d'une formation intensive sur les r\u00e9alit\u00e9s carc\u00e9rales et les droits des femmes d\u00e9tenues. Women in detention: the forgotten voices of the 16 Days Violence against women and girls remains the most widespread human rights violation worldwide. According to UN Women, the Democratic Republic of Congo (DRC) has one of the highest rates of sexual and gender-based violence (SGBV) in the world, with over 50% of Congolese women having experienced physical violence at some point in their lives. Among the most vulnerable are women deprived of their liberty. In detention, they are exposed to physical, sexual, and psychological abuse, made worse by overcrowding, isolation, and lack of appropriate resources. Yet, their stories are often absent from national and international conversations on gender-based violence. To address this silence, Ius Stella launched a dedicated campaign during the 16 Days of Activism, offering legal education sessions and free legal consultations to incarcerated women \u2013 a population too often overlooked. Victims of a broken system At the start of the campaign, 328 women were being held at Makala Central Prison, as well as 20 children under the age of five living behind bars with their mothers. Our volunteer lawyers and law students conducted five legal awareness sessions, reaching 207 women and informing them of their fundamental rights. In addition, 75 women with high-priority legal needs received individual legal consultations. Our findings were alarming: only 22.7% of the women had access to a lawyer before their detention. Nearly 8 in 10 (78.7%) were in pre-trial detention and had never appeared before a judge. The average age of participants was 34, with ages ranging from 17 to 69 years old. These numbers reflect systemic dysfunctions within the Congolese justice system \u2013 dysfunctions that carry wide-reaching consequences. Women are the backbone of our society, playing vital roles that extend far beyond the home into every facet of social and economic life. When a woman is unjustly imprisoned, the impact ripples far and wide, threatening the very fabric of our communities and collective future. A remarkable mobilization of students and lawyers One of the campaign\u2019s cornerstones was the active involvement of students from the Human Rights Club of the University of Kinshasa, as well as two partner law firms: Shematsi &amp; Associates and KMG. Sixteen law students were carefully selected and trained on prison realities and the specific rights of incarcerated women. Equipped with this knowledge, they played a key role in educating detainees about their legal rights and helping them understand available legal remedies. Their efforts were supported by dedicated lawyers from both partner firms, who provided quality legal assistance and case follow-up, helping to restore hope and dignity for many women behind bars. Recommendations for a more equitable justice system The findings of this campaign underscore the urgent need for prison reform to uphold the fundamental rights of women in detention. We call for: The formal recognition of the specific situation of incarcerated women, to adapt prison policies to their needs; Systematic data collection on women in detention to inform reform efforts and public policy; The expansion of free legal aid initiatives to ensure equal access to justice; Psychological support and humane detention conditions that respect dignity and international standards. We urge judicial authorities, development partners, and civil society to come together \u2014 not only to right individual wrongs but to build a justice system that is fair, inclusive, and worthy of our shared humanity. Women in detention: the forgotten voices of the 16 Days Violence against women and girls remains the most widespread human rights violation worldwide. According to UN Women, the Democratic Republic of Congo (DRC) has one of the highest rates of sexual and gender-based violence (SGBV) in the world, with over 50% of Congolese women having experienced physical violence at some point in their lives. Among the most vulnerable are women deprived of their liberty. In detention, they are exposed to physical, sexual, and psychological abuse, made worse by overcrowding, isolation, and lack of appropriate resources. Yet, their stories are often absent from national and international conversations on gender-based violence. To address this silence, Ius Stella launched a dedicated campaign during the 16 Days of Activism, offering legal education sessions and free legal consultations to incarcerated women \u2013 a population too often overlooked. Victims of a broken system At the start of the campaign, 328 women were being held at Makala Central Prison, as well as 20 children under the age of five living behind bars with their mothers. Our volunteer lawyers and law students conducted five legal awareness sessions, reaching 207 women and informing them of their fundamental rights. In addition, 75 women with high-priority legal needs received individual legal consultations. Our findings were alarming: only 22.7% of the women had access to a lawyer before their detention. Nearly 8 in 10 (78.7%) were in pre-trial detention and had never appeared before a judge. The average age of participants was 34, with ages ranging from 17 to 69 years old. These numbers reflect systemic dysfunctions within the Congolese justice system \u2013 dysfunctions that carry wide-reaching consequences. Women are the backbone of our society, playing vital roles that extend far beyond the home into every facet of social and economic life. When a woman is unjustly imprisoned, the impact ripples far and wide, threatening the very fabric of our communities and collective future. A remarkable mobilization of students and lawyers One of the campaign\u2019s cornerstones was the active involvement of students from the Human Rights Club of the University of Kinshasa, as well as two partner law firms: Shematsi &amp; Associates and KMG. Sixteen law students were carefully selected and trained on prison realities and the specific rights of incarcerated women. Equipped with this knowledge, they played a key role in educating detainees about their legal rights and helping them understand available legal remedies. Their efforts were supported by dedicated lawyers from both partner firms, who provided quality legal assistance and case follow-up, helping to restore hope and dignity for many women behind bars. Recommendations for a more equitable justice system The findings of this campaign underscore the urgent need for prison reform to uphold the fundamental rights of women in detention. We call for: The formal recognition of the specific situation of incarcerated women, to adapt prison policies to their needs; Systematic data collection on women in detention to inform reform efforts and public policy; The expansion of free legal aid initiatives to ensure equal access to justice; Psychological support and humane detention conditions that respect dignity and international standards.
