Le rapport, <strong><em>Besoins juridiques des femmes \u00e0 Kinshasa<\/em><\/strong>, met en lumi\u00e8re une r\u00e9alit\u00e9 commune \u00e0 ces deux groupes : le genre et le statut socio-\u00e9conomique continuent de d\u00e9terminer l\u2019acc\u00e8s effectif aux droits et aux recours.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5e23c35 elementor-widget elementor-widget-text-editor\" data-id=\"5e23c35\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u00c0 Kinshasa, les femmes sont au c\u0153ur de la vie sociale, \u00e9ducative et \u00e9conomique. Elles \u00e9tudient, travaillent, soutiennent leurs familles et contribuent chaque jour \u00e0 la survie de milliers de m\u00e9nages. Pourtant, pour beaucoup d\u2019entre elles, l\u2019acc\u00e8s \u00e0 la justice reste incertain, lointain, voire inexistant.<\/p>\n<p>Sur les campus universitaires, de nombreuses \u00e9tudiantes rapportent des situations de harc\u00e8lement, de violences bas\u00e9es sur le genre, d\u2019abus d\u2019autorit\u00e9 et de violences en ligne. Si certaines d\u00e9clarent conna\u00eetre leurs droits, tr\u00e8s peu savent vers qui se tourner concr\u00e8tement lorsqu\u2019elles sont confront\u00e9es \u00e0 une violation. La peur des repr\u00e9sailles acad\u00e9miques, la stigmatisation et la m\u00e9fiance envers les m\u00e9canismes existants contribuent \u00e0 un silence g\u00e9n\u00e9ralis\u00e9 et \u00e0 un sous-signalement massif des violences.<\/p>\n<p>Dans les march\u00e9s, les vendeuses \u00e9voluent dans un environnement tout aussi pr\u00e9caire. Majoritairement actives dans le secteur informel, sans statut l\u00e9gal clair, elles sont expos\u00e9es \u00e0 des confiscations arbitraires de marchandises, \u00e0 des amendes abusives, \u00e0 des tracasseries quotidiennes et \u00e0 des violences r\u00e9p\u00e9t\u00e9es de la part d\u2019agents publics. Pour ces femmes, souvent cheffes de m\u00e9nage, la perte de marchandises signifie une perte imm\u00e9diate de revenus et une ins\u00e9curit\u00e9 \u00e9conomique directe.<\/p>\n<p>Malgr\u00e9 des contextes diff\u00e9rents, les m\u00e9canismes sont similaires : rapports de pouvoir d\u00e9s\u00e9quilibr\u00e9s, proc\u00e9dures opaques ou co\u00fbteuses, absence de recours accessibles et peur des repr\u00e9sailles. \u00c0 travers leurs r\u00e9ponses, les femmes expriment des besoins clairs et convergents :<\/p>\n<ul>\n<li>Une justice de proximit\u00e9, accessible, humaine et digne de confiance ;<\/li>\n<li>Une information claire sur leurs droits et les recours existants ;<\/li>\n<li>Une protection effective contre les violences et les abus ; et<\/li>\n<li>Un accompagnement juridique gratuit, ancr\u00e9 dans leurs lieux de vie, qu\u2019il s\u2019agisse des universit\u00e9s ou des march\u00e9s.<\/li>\n<\/ul>\n<p>Ces attentes traduisent une demande forte : celle de ne plus \u00eatre seules face \u00e0 l\u2019injustice.<\/p>\n<p>Sur la base de ces constats, le rapport formule des recommandations concr\u00e8tes visant \u00e0 renforcer l\u2019acc\u00e8s \u00e0 la justice des femmes, notamment par :<\/p>\n<ul>\n<li>La cr\u00e9ation de m\u00e9canismes d\u2019aide sur les campus universitaires, offrant \u00e9coute, accompagnement juridique, soutien psychologique et m\u00e9canismes de signalement s\u00e9curis\u00e9s ;<\/li>\n<li>La mise en place de permanences juridiques dans les march\u00e9s, pour informer les vendeuses, documenter les abus et faciliter l\u2019acc\u00e8s aux recours ;<\/li>\n<li>Un accompagnement progressif \u00e0 la formalisation des activit\u00e9s \u00e9conomiques, combin\u00e9 \u00e0 des formations en gestion d\u2019activit\u00e9 et en droits \u00e9conomiques ; Yet for many, access to justice remains uncertain, distant, or entirely out of reach. On university campuses, many female students report experiences of harassment, gender-based violence, abuse of authority, and online violence. While some indicate that they are aware of their rights, very few know where to turn in practice when those rights are violated. Fear of academic retaliation, stigma, and mistrust of existing mechanisms contribute to widespread silence and significant underreporting of abuse. In markets, women traders operate in an equally precarious environment. Largely active in the informal sector and lacking clear legal status, they are exposed to arbitrary confiscations of goods, abusive fines, daily harassment, and repeated violence by public agents. For these women, often heads of household, the loss of merchandise translates into an immediate loss of income and acute economic insecurity. Despite these different settings, the underlying dynamics are strikingly similar: unequal power relations, opaque or costly procedures, limited access to effective remedies, and fear of reprisals. Through their responses, women articulate clear and converging needs: Accessible and trusted community-based justice; Clear, practical information about their rights and available remedies; Effective protection against violence and abuse; and Free legal support rooted in their everyday spaces, whether on campus or in the markets. These expectations reflect a strong and consistent demand: They no longer want to face injustice alone. Building on these findings, the report puts forward concrete and actionable recommendations to strengthen women\u2019s access to justice. These include: The creation of support mechanisms on university campuses offering legal assistance, psychosocial support, and secure reporting channels ; The establishment of regular legal aid clinics in markets to inform women traders, document abuses, and facilitate access to remedies ; Progressive support for the formalisation of economic activities combined with training in business management and economic rights ; and Conducting a larger-scale study to generate representative data on women\u2019s legal needs in Kinshasa and, in the longer term, across the Democratic Republic of Congo. This report matters because it goes beyond documenting violations. It provides an evidence base for action, advocacy, and dialogue with public authorities, universities, and technical and financial partners. The report, Legal Needs of Women in Kinshasa, highlights a shared finding across both groups: gender and socio-economic status continue to shape who can effectively claim rights and access remedies. In Kinshasa, women are central to social life, education, and the economy. They study, work, support their families, and contribute every day to the survival of thousands of households. Yet for many, access to justice remains uncertain, distant, or entirely out of reach. On university campuses, many female students report experiences of harassment, gender-based violence, abuse of authority, and online violence. While some indicate that they are aware of their rights, very few know where to turn in practice when those rights are violated. Fear of academic retaliation, stigma, and mistrust of existing mechanisms contribute to widespread silence and significant underreporting of abuse. In markets, women traders operate in an equally precarious environment. Largely active in the informal sector and lacking clear legal status, they are exposed to arbitrary confiscations of goods, abusive fines, daily harassment, and repeated violence by public agents. For these women, often heads of household, the loss of merchandise translates into an immediate loss of income and acute economic insecurity. Despite these different settings, the underlying dynamics are strikingly similar: unequal power relations, opaque or costly procedures, limited access to effective remedies, and fear of reprisals. Through their responses, women articulate clear and converging needs: Accessible and trusted community-based justice; Clear, practical information about their rights and available remedies; Effective protection against violence and abuse; and Free legal support rooted in their everyday spaces, whether on campus or in the markets. These expectations reflect a strong and consistent demand: They no longer want to face injustice alone. Building on these findings, the report puts forward concrete and actionable recommendations to strengthen women\u2019s access to justice. These include: The creation of support mechanisms on university campuses offering legal assistance, psychosocial support, and secure reporting channels ; The establishment of regular legal aid clinics in markets to inform women traders, document abuses, and facilitate access to remedies ; Progressive support for the formalisation of economic activities combined with training in business management and economic rights ; and Conducting a larger-scale study to generate representative data on women\u2019s legal needs in Kinshasa and, in the longer term, across the Democratic Republic of Congo. This report matters because it goes beyond documenting violations. It provides an evidence base for action, advocacy, and dialogue with public authorities, universities, and technical and financial partners.
